Nairobi High Court has certified as urgent the petition filed by Center for.Litigation Trust {CLT) against President Ruto's 65 state firms sale plan without public participation
Justice Jaitus Ngaah shall give further directions on 15th December , 2025 when the case comes for hearing.
The Center for Litigation Trust {CLT) sued National Treasury seeking to block the implementation of the newly enacted Government Owned Enterprises Act which allows the planned sale of 65 state firms.
CLT argued that sweeping restructuring of State Corporations violates constitutional safeguards , lacks public participation and risks undermining Parliament's role of overseeing strategic national assets.
The Government Owned Enterprises Act was signed into law by President William Ruto in readiness for the sale of 65 State Corporations, including Kenya Pipeline etc.
The petition names the Treasury Cabinet Secretary and Attorney General as respondents, accusing them of sidelining Parliament and the public in managing strategic national assets.
Under the new framework, the Treasury CS has exclusive authority to hold shares, appoint boards and executives, set strategic directions and oversee finances.
CLT, through an affidavit signed by Executive Director Julius Ogogoh, says the powers may erode the parliamentary oversight role under articles 95 and 96 of the constitution.
CLT seeks a Court declaration nullifying the law and suspending its implementation.
