CLT Moves to High Court to Challenge Kenya Railways MD Over Stay in Office

Kenya Railways Corporation (KRC) Managing Director Philip Mainga's term in office allegedly expired on or about February 2, 2026.

The Centre for Litigation Trust filed a petition this week to challenge the legality of Mainga's continued occupation of the office even after his second term expired.

CLT's Petition, before the High Court's Constitutional and Human Rights Division in Nairobi, argues that the KRC's Managing Director's continued stay in office raises serious constitutional and statutory questions regarding the lawful exercise of public authority within the state agency.

Mainga's first term expired on 2nd  February, 2023 after which he was reportedly granted a further three-year term.

CLT argues that the 2nd term also expired on 2nd February, 2026, but Mainga has continued to occupy office and exercise the power and functions of the office.
