The Center for Litigation Trust CLT has petitioned the Mombasa High Court to compel the Mombasa County government to make public the controversial Sh17billion waste Management tender.
Through Executive Director Julius Ogogoh, CLT cited a lack of public participation in the award of the tender to Jospong Group, a Ghanaian-owned group of Companies.
In an application filed under certificate of urgency, the Center for Litigation Trust said the county mysteriously awarded the tender for design, building, financing, maintaining, operating, and transferring of waste to an energy processing plant in Mwakirunge for the financial years 2024/2025/2026, without approval of the County Assembly or public participation.
The County Executive Member of Finance, Jospong Group of Companies, and the Speaker of the County Assembly of Mombasa are among those sued as interested parties.
Justice Jaitus Ngaah on Thursday allowed the application and directed the County and all the interested parties to file their response within 7 days.
"In the meantime, respondents and the interested parties are directed to file and serve their response to the application within seven days of the date of service of the application." Justice Ngaah orders
The case will be mentioned on December 10, 2025, for further directions.
